Areas of Practice
We represent our clients on a variety of matters, including the following:
Aboriginal Rights & Title Claims, including judicial reviews of administrative decisions, interlocutory injunctions, and appearances at all levels of court, relating to both asserted aboriginal rights as well as historic treaties;
Referrals, Consultation & Accommodation Negotiations with government and industry, including access and benefit agreements, regarding proposed development of land and natural resources, including Independent Power Projects, Forestry, Mining, Oil & Gas exploration and pipelines;
Advocacy in Administrative and Regulatory Processes, such as environmental assessments, BC Utilities Commission hearings, and other matters;
Specific Claims, by preparing and submitting claims and by negotiating settlements. We have worked on all types of specific claims, including claims relating to Expropriations, Roads, Timber disputes, Trust Funds, Survey errors, and Reserve Boundaries. Treaty Negotiations, by providing analytical support for modern treaty negotiations and as an advocate at the table;
Government to Government negotiations, including land-use plans, collaborative drafting of legislation and regulations, municipal service agreements, archaeological and heritage site management;
Residential School Claims in both the Individual Assessment Process and litigation, and in working with societies established to assist survivors;
Corporate matters, including the establishment of all forms of business entities required to pursue economic development opportunities, including corporations, limited partnerships, joint ventures, shareholder agreements and partnership agreements. We also create Societies or other non-profit entities, advise on their governance and administration, and assist with charitable registration of such;
Commercial and Tax matters, including the purchase and sale of businesses, leasing, advance rulings from Canada Revenue Agency, and related matters.
Trust Matters, including the establishment and administration of trusts designed to receive funds arising from treaties, specific claims and commercial agreements.
Governance & Administrative Matters, including advice and assistance with by-laws, constitutions, policies & procedures, employment and consultant relations.
